03 How has our understanding of the Constitution changed since 1789?

 

This unit looks at the question of whether or not the U.S. should interpret the Consitution in a strict, original document way, or change its interpretation over time. We will be examining the ideas of strict constructionists, "radical judges", and shifting ideas over centuries.

Unit Essential Questions

 

o What are the main approaches to interpreting the Constitution? What makes each popular?

What do people mean when they talk about “activist judges”? Is this a just assessment?

o What is the history of balancing state and federal power? What is the future?

o How easy is it to amend the Constitution? Should it be harder (or easier) to amend? Why?
